*Subject: Urgent Legal Memorandum in Support of the American Review Project Regarding Revoking the Legitimacy of the De Facto Authority in Port Sudan as a Sponsor of Terrorist-Designated Battalions and Subject to the Domination of Terrorist Islamist Leaders*
*Your Excellency, Honorable Minister,*
*Honorable Members of the Committees,*
*Greetings,*
I submit to you this urgent legal memorandum, not in my personal capacity, but in my capacity as a Sudanese citizen and with the voice of millions of Sudanese who have fallen under the grip of a military authority that has lost legitimacy and sovereignty. I fully and firmly support the review project currently underway at your esteemed administration to review international recognition and revoke the legitimacy of the de facto government in Port Sudan, based on established legal facts proving that it is a sponsor of terrorist-designated battalions, and is subject to direct domination by oppressive terrorist Islamist leaders against the people.
*First: Legal Basis for Revoking Legitimacy and Urgent Intervention*
1. *Defect of Origin and Terrorist Domination*: _The authority’s assumption of power via the October 25, 2021 coup, and the control of terrorist Islamist leaders over the joints of the state and its security and economic institutions, making the Port Sudan government an oppressive tool against the people rather than representative of them. This violates the rule of “no right arises from an unlawful act” established by the International Court of Justice in the Namibia Advisory Opinion 1971._
2. *Violation of Counter-Terrorism Obligations*: _Integration of terrorist-designated armed militias and battalions into state apparatuses, and providing them with funding, armament, and legal cover, in explicit violation of Security Council Resolutions 1373 and 1540_.
3. *Loss of Capacity for Representation*: _Pursuant to Article 4 of the United Nations Charter, the authority has lost the condition of “love of peace” by transforming into an instrument of repression in the hands of terrorist Islamist leaders who practice brutality and persecution against citizens_.
*Second: State Collapse and Comprehensive Administrative Chaos*
_Under the domination of these terrorist Islamist leaders, the Sudanese state has entered a state of comprehensive collapse in all aspects of citizens’ lives: collapse of the health system, cessation of education, economic collapse, rampant corruption, and absence of security. This systematic chaos constitutes a crime of gross negligence against the Sudanese people, and violates the state’s obligations under the International Covenant on Economic, Social and Cultural Rights._
*Third: Criminal and Humanitarian Responsibility*
1. *Command Responsibility*: _The Commander-in-Chief bears responsibility for the massacre of the dispersal of the General Command sit-in on June 3, 2019, under Article 28 of the Rome Statute, which was documented by Amnesty and Human Rights Watch as a crime against humanity under Article 7._
2. *Silence as Evidence of Complicity*: _Failure to condemn the incident of North Al-Wadi proves complicity or gross negligence, and violates the duty of protection under the Four Geneva Conventions of 1949 and Additional Protocol I of 1977, and Article 6 of the International Covenant on Civil and Political Rights._
3. *Violation of Sovereignty*: _Unity of victim, place, and moral perpetrator constitutes a violation of Article 2(4) of the United Nations Charter._
*Fourth: Rejection of Peace as Evidence that it is a War Authority*
_The authority’s rejection of all peace initiatives and its adoption of a policy of evasion violates Article 33 of the United Nations Charter and Security Council Resolution 1325, and proves that it is a war authority, not a state authority_.
*Urgent Concluding Requests*
_Based on the foregoing, I request that Your Excellency and the Honorable Members of Congress take all urgent measures capable of the following_:
1. _Immediately revoke international legitimacy from the Port Sudan government for its establishment on a coup and domination by terrorist Islamist leaders oppressive to the people_.
2. _The U.S. administration shall take all urgent measures capable of liberating the people of Sudan from the grip of these terrorist Islamist leaders dominating the joints of the state._
3. _Stop this systematic chaos and state collapse in all aspects of citizens’ lives, through strict legal and punitive measures under American anti-terrorism legislation_.
4. _Support the Sudanese people in restoring their civilian state and full sovereignty away from militia and gun rule and the domination of terrorist organizations_.
_International legitimacy is not granted to those who lead tanks, embrace terrorism, and oppress their people, but is granted to those who protect lives, preserve dignities, and make peace._
